1. Introduction & Acceptance

Welcome to Nickit (“we”, “us”, or “our”). Nickit is a peer-to-peer fashion marketplace operated from the United Kingdom. By accessing or using our platform at nickit.co.uk (the “Platform”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms in full, you must not use the Platform. We reserve the right to update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. You should check this page periodically.

2. Platform Overview

Nickit is a two-sided marketplace that enables individual users (“Sellers”) to list preloved fashion items for sale and other users (“Buyers”) to purchase those items. Nickit acts as a facilitator and is not a party to any transaction between Buyers and Sellers.

Nickit does not own, inspect, or guarantee the items listed on the Platform. All listings are created and managed by independent Sellers. We provide tools, payment infrastructure, and buyer protection to support safe transactions.

3. User Accounts

To buy or sell on Nickit you must register for an account. You must be at least 18 years old (or 16 with parental consent) and a UK resident, or otherwise permitted to use the Platform under applicable law.

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your password.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately at hello@nickit.co.uk of any unauthorised use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Seller Terms

Listing Standards

All items must be accurately described. Photos must be of the actual item. Sellers must disclose any defects, damage, or significant wear honestly. Misleading listings may result in account suspension and may give rise to legal liability.

Prohibited Items

See Section 6 for the full list of prohibited items. Sellers are solely responsible for ensuring their listings comply with all applicable laws, including consumer protection and product safety legislation.

Fee Structure

Nickit charges a 10% platform fee on the final sale price of each item sold. This fee is deducted automatically from the seller’s payout. There are no listing fees. Stripe payment processing fees are additional and are deducted before the seller payout is calculated. See Section 7 for full details.

Sellers are responsible for fulfilling orders promptly, providing accurate shipping information, and communicating with buyers regarding their purchases. Sellers must dispatch items within 3 business days of sale unless otherwise agreed.

5. Buyer Terms

By placing an order, Buyers enter into a contract with the Seller for the purchase of the listed item. Nickit facilitates payment via Stripe but is not a party to the sale contract.

Buyer Protection

Nickit provides Buyer Protection on all eligible purchases. You are covered if:

  • Your item does not arrive within the estimated delivery window.
  • The item received is significantly not as described.
  • The item arrives damaged due to inadequate packaging by the Seller.
  • You receive a counterfeit item.

To raise a dispute, contact us within 7 days of delivery (or the expected delivery date if non-arrival) via hello@nickit.co.uk. Nickit’s decision in disputes is final. Payments are processed securely via Stripe. Card details are never stored on Nickit servers.

6. Prohibited Items

The following items are strictly prohibited on Nickit. Listings of prohibited items will be removed and repeat violations will result in permanent account suspension:

  • Counterfeit or replica goods (fake designer items, knock-offs)
  • Illegal items or items that infringe third-party intellectual property rights
  • Weapons, knives, firearms, or anything prohibited under UK law
  • Drugs, drug paraphernalia, or controlled substances
  • Stolen goods or items obtained through illegal means
  • Adult or sexually explicit content
  • Items that promote hate, violence, or discrimination
  • Hazardous materials, chemicals, or recalled products
  • Living animals or animal products prohibited under CITES
  • Items subject to export restrictions or sanctions

7. Fees & Payments

All transactions on Nickit are conducted in GBP (£). Payments are processed by Stripe, Inc. (“Stripe”), a third-party payment processor. By using Nickit, you agree to Stripe’s Terms of Service.

Platform fee: 10% of the final sale price, deducted from the Seller’s payout.

Stripe processing fees: Standard Stripe fees apply and are deducted in addition to the platform fee. Current Stripe UK rates are available at stripe.com/gb/pricing.

Seller payouts: Seller earnings are paid out via Stripe Connect. Sellers must connect a Stripe account to receive payouts. Payouts are typically processed within 2–7 business days after a sale is confirmed, subject to Stripe’s payout schedule and any applicable hold periods.

Nickit reserves the right to withhold payouts in the event of an open dispute or suspected fraudulent activity until the matter is resolved.

8. Disputes & Buyer Protection

In the event of a dispute between a Buyer and Seller, we encourage both parties to communicate directly via the Nickit messaging system in the first instance. If a resolution cannot be reached, either party may escalate the dispute to Nickit by contacting hello@nickit.co.uk.

Nickit will review the evidence provided by both parties and may request additional information. We aim to resolve all disputes within 5 business days. Our decision in any dispute is final and binding on both parties.

Where Buyer Protection applies, Nickit will issue a full refund to the Buyer. Chargebacks raised directly with card issuers without first contacting Nickit may result in account suspension.

9. Intellectual Property

The Nickit name, logo, and all associated branding, design elements, and platform software are the intellectual property of Nickit and are protected by copyright, trade mark, and other applicable laws. You may not use our branding without prior written consent.

By uploading photos and content to Nickit, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content for the purpose of operating and promoting the Platform. You retain ownership of your content. You warrant that you have the right to upload any content you post.

10. Privacy & Data

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Nickit you consent to the processing of your personal data in accordance with that policy. We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Nickit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, including but not limited to loss of profits, loss of data, or damage to reputation.

Nickit’s total aggregate liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total fees paid by you to Nickit in the 12-month period preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

12. Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any disputes.
